How do Australian psychosocial risk laws apply to neurodivergent workers

Have you ever wondered why neurodivergent employees are so often described as more vulnerable to psychosocial hazards at work?

Or why neurodivergence needs to be part of how organisations understand psychosocial risk, not a panicked afterthought once someone is already struggling?

Before I get started on open-plan offices, I feel compelled to pre-emptively say that yes, I know no one has ever said, “I simply adore fluorescent lighting,” or “Nothing makes my day like Brian from accounts heating tuna in the microwave.”

Open-plan offices can be the pits for anyone, regardless of neurotype.

The difference is the impact.

Psychologically safe workplaces and psychosocial hazards are getting more attention, and rightly so. A quick glance at workers’ compensation data paints a very clear picture: workplaces that are detrimental to people’s mental health are costly. Costly for individuals, costly for teams, and costly for organisations.

But something that often hides in plain sight is how these psychosocial hazards, low job clarity, poor workplace conditions, poor environmental conditions etc. may apply differently to neurodivergent workers.

What changes is the risk profile.

For neurodivergent workers, the same workplace conditions can land differently, accumulate faster, and cause harm sooner because the workplace has usually been designed around one assumed operating system.

And if your risk controls only work for one operating system, they are not really controls. They are preferences dressed up as policy.

Psychosocial risk ≠ stress

When people hear “psychosocial risk,” they often think of stress in a vague, individualised way - especially if the topic of mental health is uncomfortable or new territory. Someone is overwhelmed. Someone needs resilience training. Someone should use the EAP.

But psychosocial risk is not just about whether a person is stressed.

It is about the design and management of work.

It asks: could the conditions of this workplace cause psychological harm?

That distinction matters because it moves the conversation away from “what is wrong with this person?” and towards “what is happening in this environment?”

For neurodivergent employees, that shift is essential.

Too often, neurodivergent workers are treated as difficult. Their sensory needs, communication preferences, processing differences, executive functioning patterns, or recovery requirements are framed as issues to manage.

But the risk is not neurodivergence.

The risk is a workplace that has not considered neurodivergence in how it designs roles, environments, expectations, communication, and support.

The hazard might be the same, but the impact is not

Let’s use environmental conditions as an example and I’ll illustrate with my lived experience.

I am incredibly sensitive to sensory input, with the biggest culprits being scent, noise, and light. I also want to say clearly that I don’t hate working in an office. Some of my closest friendships have been made at work. Even now, understanding my sensory sensitivity more clearly, I would still choose to go into an office periodically because I do not, in fact, hate humans.

But working extensively in an open-plan office without accommodations can leave my body in physical pain by the end of the day.

That is not hyperbole.

That is the impact of trying to assimilate into an environment that was treated as normal for a very long time: five days a week in the office, bright lights, constant background noise, interruptions, hot-desking, meeting rooms with glossy tables and whiteboards, competing conversations, people moving around in your peripheral vision, and no meaningful control over your sensory environment.

For me, fluorescent lighting is not just annoying. It can be physically painful. Glossy surfaces can make it worse.

Noise is not just distracting. It can be dysregulating.

Scent is not just unpleasant. It can be overwhelming to the point of hyperventilation. (Looking at you, perfume 👀).

I also have poor body interoception, which means my brain and body are not always communicating with each other clearly. So it can be hard for me to judge the impact in real time. I can look like I am coping. I can believe I am coping. I can keep tolerating it until suddenly - like, very suddenly - I cannot.

And once I reach that point, it is very hard to come back from.

That is what psychosocial risk can look like for a neurodivergent worker.

  • Not “I dislike the office.”

  • Not “I prefer working from home.”

  • Not “I am entitled.”

But that this environment is slowly beating me down, causing genuine harm, and the systems around me mean I have no agency to change it.

Unexamined design is the risk

Role clarity is another good example, and it deserves its own conversation.

In many workplaces, ambiguity is treated as a normal part of professional life. You are expected to read between the lines, infer priorities, know when something is urgent, understand what “circle back” actually means, and somehow distinguish between a brainstorm, a decision, a suggestion, and a non-negotiable instruction.

For some people, that ambiguity is mildly frustrating.

For many neurodivergent workers, it can be a major psychosocial hazard.

The point is not that every neurodivergent person needs the same thing. The point is that workplace conditions are not neutral just because they are normalised.

Neurodivergence is not the hazard.

The hazard is a workplace that assumes everyone processes information, sensory input, expectations, ambiguity, and pressure in the same way.

And once we understand that, the question changes.

It is no longer, “How do we help this person cope?”

It becomes, “What conditions are we asking people to cope with in the first place?”
